INTRODUCTION
Scientists, accustomed to working with and advancing the
state of the art, are apt to forget that those in earlier times did not possess
the information they take for granted. Individuals in the legal profession tend
to have a better appreciation for this reality since their work is grounded in
the evolutionary process that defines precedent; indeed, questions of “who knew
what and when” are central to some cases. However, lawyers and judges too can
benefit from a better understanding of the facts and mindsets that have informed
decisions made in the past.
